What is First Information Report?
First Information Report is an information regarding the occurrence of the offence which is cognizable by the police. If an offence which is cognizable by the Police under section 154 of the Criminal Procedure Code then the police will register about the offence in the Register No. 1 available in the Police Station.
What to do if police does not register FIR.
Under the Code of Criminal Procedure police is bound to register about the information of the cognizable offence but in most of the criminal cases police delay registration of the First Information Report (FIR). Therefore, under Section 22-A(6) of the Code of Criminal Procedure Code, Justice of Peace has the power to direct the Police to Register the FIR. How to write application for the Registration of FIR.
It should be kept in mind before the writing an application for the registration of the FIR that Police register FIR only on those grounds which make any offence cognizable under the Criminal Procedure Code. Otherwise police will not register the case. In most cases people write wrong application for the registration of the case or sometimes FIR is register wrongly which does not make a criminal cognizable case or if the case is made out but the conviction to the accused is not made since the FIR was made against the laws and facts of the case. Therefore, it is necessary to bring the case under the domain of law FIR must be registered under the law in accordance with the facts and circumstances of the case.
