Registration of First Information Report in Pakistan.
What is First Information Report?
When offence, which is cognizable by the police is reported to the police by a person or the police get the information from its own sources then this information is reported in the Register Number 1 available in the Police Station of the area where the offence was committed.
What happen after the Registration of FIR.
After the registration of the First Information Report (FIR) the police investigation is started and the investigation officer reaches on the crime scene where the offence was committed, writes down first inspection note wherein the crime scene plan is drawn by him.
Recording of evidence.
The second thing which the investigation officer does is that he records the statement of the witnesses u.s 161 of the Criminal Procedure Code. Therein the statements of the witnesses who knows about the commission of the offence got recorded, including the accused who alleged something.
Collection of evidence.
After reaching the crime scene the investigation officer collect all the material i.e. blood sample, weapons, anything which is necessary for establishing the commission of the offence.
Submission of challan before the Magistrate.
After registration of First Information Report (FIR) investigation officer is bound to submit the compete challan before the Magistrate within 15 days from the registration of the First Information Report and if the investigation officer is failed to submit the complete challan then within next 3 days from the expiry of the 15 days the incomplete challan shall be submitted to the Magistrate. If the Investigation officer does not submit the challan within the stipulated time then the complainant can file an application for the submission of the challan before the Magistarate.
Framing of charges before commencement of trial before Magistrate.
After submission complete challan the Magistrate start trial of the case. Before the starting of the trial issues are frames wherein allegations are formed in way which will clearly informed the accused person about the nature of offence which he was accused of.
